Public Consultation launched on the draft Child Adoption Bill and the draft Code Civil Mauricien (Amendment) Bill

The Ministry of Gender Equality and Family Welfare is circulating two major pieces of draft legislation, the Child Adoption Bill and the Code Civil Mauricien (Amendment) Bill, for public consultation. Both draft Bills will be posted on the website of the Ministry of Gender Equality and Family Welfare.

The Draft Child Adoption Bill

The main object of the draft Bill is to provide a legal framework for the domestic adoption and intercountry adoption of children and give effect to the Convention on Protection of Children and Co-operation, in respect of Intercountry Adoption, concluded on 29 May 1993, to which the Republic of Mauritius is a signatory.

The draft Bill also makes provisions for the establishment of the Mauritius Child Adoption Authority which shall be responsible for matters relating to domestic adoption and intercountry adoption of children, and act as the Central Authority for the purpose of the Convention on Protection of Children and Cooperation in respect of Intercountry Adoption.

Additionally, the draft Bill outlines the principles governing the adoption of children and establishes mechanisms to monitor the pre-adoption and post-adoption process and ensure the protection of children prior to and after the adoption. It also introduces a mandatory certificate of eligibility for the prospective adoptive parent along with the conditions that they should satisfy for that purpose, and ensures the matching of children with the prospective adoptive parent.

The Draft Code Civil Mauricien (Amendment) Bill

The Draft Code Civil Mauricien (Amendment) Bill seeks to amend the Code Civil Mauricien to align the procedures for adoption with the United Nations Convention on the Rights of the Child and changes in societal norms in relations to the adoption.
